Today, the Federal Court of Canada has ruled that the invocation of the Emergencies Act (formerly known as the War Measures Act) was “unreasonable and unjustified”. Justin Trudeau famously invoked the Act in 2022 in order to freeze bank accounts and arrest peaceful demonstrators. With the support of the NDP, he passed the Emergencies Act that was meant to deal with terrorist threats.
More importantly the Chief Justice said that the use of the Emergencies Act violated Charter Rights! The Emergencies Act can only be invoked if other measures are not working. That is, that the criminal code, provincial and municipal laws cannot be enforced. As we saw across every single province the local and provincial police were handling the protest without the need of the Emergencies Act. Other than the on going miscarriage of justice involving the Coutts boys, not one criminal charge was laid. All Police Forces testified that they had NOT asked the federal government to invoke the act. This was clearly not an insurrection and the government and the citizens of Canada were never under any threat. Further there is the issue of 'minimum of harm'. The use of the Emergencies Act froze the bank accounts of people who were not even involved in the protest but supported the protest financially. A waitress, a single Mom, gave $20 to support the truckers, consequentially she had her bank account frozen! If one person in a family supported the Truckers the entire family suffered if the joint account of the family bread winners were frozen. This is what the judge meant when he found that the use of the Emergencies Act violated the statute of 'minimum harm'. Further, and most bizarre, is that Freeland and other cabinet Liberals keep saying that they enacted the vaccine mandated on the advise of 'experts'. Under sworn testimony the head epidemiologist for Health Canada said that they never once advised the Liberal government that "......lockdowns or vaccines would mitigate the virus." This was 100% political and never had anything to do with health or science. Here is a link to the video.
